AGREEMENT TO OUR TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "user") and HYPERHIVE TECHNOLOGIES LTD. ("HyperHive", "we", "us", "our") concerning your access to and use of our website, desktop applications, mobile applications, and all related tools and services (collectively, the "Services").

By accessing or using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms.

IF YOU DO NOT AGREE WITH THESE TERMS, YOU MUST STOP USING THE SERVICES IMMEDIATELY.

We may update these Terms from time to time. The "Last Updated" date reflects the most current version. Your continued use of the Services following updates constitutes acceptance of the revised Terms.

The Services are intended for individuals 18 years or older.

OUR SERVICES

HyperHive provides a unified workspace that includes documents, whiteboards, databases, AI-assisted tools, collaboration features, automation, and other productivity functions.

Users accessing the Services from regions where local laws differ are solely responsible for ensuring compliance with their jurisdiction.

Our Services are not designed for industries requiring specialized regulatory compliance (e.g., HIPAA, FISMA, GLBA). If your workflow requires such standards, you are not permitted to use HyperHive for those purposes.

INTELLECTUAL PROPERTY RIGHTS

Our Rights

HyperHive owns or holds licenses to all intellectual property on the Services, including but not limited to:

• software, source code, and backend systems
• databases and architecture
• UI/UX design
• text, images, graphics, and audiovisual content
• trademarks, service marks, and branding elements

All HyperHive content ("Content") and branding materials ("Marks") are protected by global copyright, trademark, and unfair competition laws.

Your License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• access and use the Services
• download or print content for personal or internal business use

You may not, without permission:

• copy, redistribute, sell, sublicense, or publicly display our Content or Marks
• modify or reverse engineer any portion of the Services
• commercially exploit the Services or Content
• remove proprietary notices

Any breach of these rights terminates your license immediately.

USER REPRESENTATIONS

By using HyperHive, you represent and warrant that:

• all registration information is truthful and current
• you will maintain the accuracy of your account information
• you have the legal capacity to agree to these Terms
• you are not a minor
• you will not access HyperHive through bots or automated scripts
• you will not use the Services for unlawful activities
• your use complies with all applicable laws

Violation may result in suspension or termination.

USER REGISTRATION

You may need to register an account to access certain features.

You agree to:

• keep your password confidential
• be responsible for activities under your account
• not impersonate others

We may remove or modify usernames considered inappropriate or misleading.

PURCHASES AND PAYMENT

HyperHive offers free and paid subscription plans.

By purchasing a subscription, you agree that:

• all payments are processed using your selected payment method
• charges may recur automatically until cancelled
• you authorize us to charge recurring payments without further consent
• all payments are non-refundable unless required by law
• we may adjust pricing with prior notice
• taxes may apply depending on your location

We reserve the right to refuse or limit any order or account suspected of fraudulent or abusive behavior.

CANCELLATION

Subscriptions may be cancelled at any time through your account settings. Cancellation stops future billing but does not refund previous payments.

Your plan remains active until the end of the paid period.

SOFTWARE

If using HyperHive’s downloadable applications:

• software is licensed, not sold
• provided "as is" without warranties
• cannot be modified, redistributed, or reverse engineered

Any violation may result in access termination.

PROHIBITED ACTIVITIES

You agree not to:

• scrape, mine, or extract data without permission
• attempt to bypass security features
• interfere with platform operation
• impersonate others
• upload harmful code (viruses, bots, worms, etc.)
• harass, threaten, or harm other users
• use automated systems or scripts
• violate intellectual property rights
• misuse support channels
• attempt unauthorized account access
• use HyperHive for illegal or abusive purposes

We may suspend or terminate accounts violating this section.

USER CONTRIBUTIONS

HyperHive may allow you to upload, store, or publish content ("Contributions").

By posting Contributions, you confirm that:

• you own or are authorized to use the content
• the content is not harmful, illegal, or infringing
• the content is not confidential

You grant HyperHive a worldwide, royalty-free license to store, display, and process your content solely to operate and improve the Services.

We may remove content violating these Terms.

AI FEATURES

HyperHive includes AI-assisted tools. By using them, you acknowledge that:

• AI output may be incorrect or incomplete
• AI should not be used for medical, legal, financial, or safety-critical decisions
• you should not upload sensitive or confidential data unless necessary
• some data may be processed through trusted third-party AI model providers
• AI outputs do not represent HyperHive’s opinions

HyperHive may use anonymized or aggregated data to improve AI systems.

THIRD-PARTY SERVICES

HyperHive may integrate with external platforms (e.g., GitHub, cloud storage, OAuth providers).

We are not responsible for:

• content hosted externally
• actions of third-party providers
• data shared through external integrations

Your interactions with third-party services are governed by their own terms.

MODIFICATIONS & INTERRUPTIONS

We may:

• update, modify, or discontinue parts of the Services
• perform maintenance causing interruptions
• change or remove features without notice

We are not liable for downtime or data loss caused by maintenance or technical issues.

COPYRIGHT INFRINGEMENT

If you believe HyperHive contains content that infringes your copyright, contact us with a DMCA-style notice.

We may remove infringing material and take further action.

LIMITATION OF LIABILITY

To the fullest extent permitted by law:

• HyperHive is not responsible for indirect, incidental, or consequential damages
• total liability is limited to the amount you paid in the last 3 months
• we are not liable for service interruptions, data loss, or AI errors

Some regions may not allow such limitations; in those cases, limits apply only to the extent allowed by law.
